
RISE Youth Basketball Academy Terms & Conditions (NSW)

These Terms apply to all RISE programs, including term classes, trial packs, class packs, holiday camps, clinics, and any “Excellence Package” inclusions.
1) Definitions

Athlete: the child participating in a RISE program.

Parent/Guardian: the person who enrols and pays for the Athlete and is responsible for compliance with these Terms.

Services: all programs and services provided by RISE (term classes, sessions, packs, camps, clinics, bonus sessions, Excellence Packages).

Term Program: a program delivered over multiple weeks during a school term.

Session: a single scheduled class.
-
Trial Pack: a paid 1-class entry option (no free trial).
-
Class Credit / Credit: a credit issued by RISE that can be used to book a future Session (not cash).
-
Camp: holiday camp or similar program delivered over one or more days.
-
Venue: any facility where RISE delivers Services (including school gyms and hired courts).
2) Acceptance of Terms
By enrolling in, attending, or paying for any RISE Service, you agree to these Terms on behalf of yourself and the Athlete.
3) Enrolment, eligibility, and placement

Eligibility: Athletes must meet the age and/or skill requirements for the class level at the time of enrolment.

Placement decisions: For safety and development, RISE may recommend or require an Athlete to move to a different level or group.

Capacity: Spots are limited and not guaranteed until payment is received (unless we confirm otherwise in writing).

Health and behavioural suitability: Participation is conditional on the Athlete being fit to participate safely and following the Behaviour Code (Section 11).
4) Fees, payment, and receipts

Fees: Prices are as shown on the website/checkout or provided in writing for the relevant Service.

Payment methods: Online payments may be processed via Stripe or Udio (or other payment providers we may introduce). Bank transfer may be accepted by arrangement.

Payment timing: Payment is required in full to confirm enrolment, unless we agree to a payment plan in writing.

Failed/overdue payments: If a payment fails, is reversed, or is overdue, RISE may suspend participation until the outstanding amount is paid.

Chargebacks: If you initiate a chargeback without first contacting us to resolve the issue, we may suspend participation while the matter is investigated.

Receipts: Receipts are issued electronically or can be requested.
5) Attendance, cancellations, and class credits (Term Programs, packs, and sessions)
This section sets the operational rule: 24+ hours notice = credit. Less than 24 hours = class counted as used.

No free trial: RISE does not offer free trial classes. To attend for the first time, you must purchase a Trial Pack (1 class) or other offered option.

Cancelling a Session (Parent/Guardian):
-
If you notify RISE at least 24 hours before the Session start time, you will receive a Class Credit for that Session.

If you notify RISE less than 24 hours before the Session start time, or do not attend, that Session is counted as used (no credit), except where RISE chooses (at its discretion) to provide a credit due to exceptional circumstances.

How credits are used:
-
Credits can be used to book a future Session subject to availability, safety, and level fit.
-
Credits are not cash and cannot be exchanged for money (except where required under Australian Consumer Law).

Credit expiry: Credits expire at the end of the following term (e.g., a missed Session in Term 1 must be used by end of Term 2).
-
Make-up limits: There is no set limit on the number of eligible credits, but all credits remain subject to expiry and availability.

Transfers: Credits are generally not transferable. RISE may allow a transfer (e.g., between siblings) only with written approval and only if appropriate for the receiving Athlete.
6) Changes, cancellations, or rescheduling by RISE
RISE may need to change or cancel a Session/Service due to factors such as coach illness, Venue unavailability, safety concerns, low enrolments, or events outside our reasonable control.

Notice: We will aim to provide as much notice as reasonably possible.

If RISE cancels a Session: We will provide one of the following (chosen reasonably by RISE):

a replacement Session; or
-
a Class Credit; or
-
a refund where required under Australian Consumer Law (see Section 8).

Weather: Classes are generally not affected by weather due to indoor venues. If weather (or weather-related access/safety issues) prevents a Session from running, RISE will provide a Class Credit (or another remedy if required under ACL).

Low enrolments: If a program is cancelled due to low numbers (especially before it starts), RISE will provide a credit or refund, acting reasonably and consistent with ACL.
7) No-shows and lateness
-
No-shows / late cancellations: If you do not attend or cancel with less than 24 hours’ notice, the Session is counted as used.

Late arrival: Athletes may join late, but coaches may restrict certain activities until it is safe to participate (e.g., warm-up requirements).
8) Refunds, credits, and Australian Consumer Law (ACL)
-
Change of mind: RISE does not offer refunds for change of mind, scheduling conflicts, or missed Sessions that are counted as used under these Terms.

ACL rights remain: Nothing in these Terms excludes, restricts, or modifies rights you may have under the Australian Consumer Law.

Where ACL requires a remedy: If you are entitled to a remedy under ACL (for example, due to a major failure), RISE will provide the required remedy (which may include a refund, replacement, or other remedy depending on the circumstances).
9) Inherent risk and assumption of risk
Basketball is a physical sport. Participation involves inherent risks including, for example, sprains, strains, collision/contact injuries, accidental impact, and aggravation of pre-existing conditions. By enrolling, you acknowledge these inherent risks.
10) Medical information, consent, and emergencies

Disclosure: Parent/Guardian must disclose relevant medical conditions, allergies, injuries, learning/behavioural support needs, and any other information that may affect safe participation.

Fitness to participate: You confirm the Athlete is fit to participate and will not attend if unwell or injured in a way that makes participation unsafe.

Medication: Athletes must bring required medication (e.g., asthma inhaler/EpiPen) and Parent/Guardian must inform coaches where it is and any relevant instructions.

Emergency consent: You authorise RISE staff to seek medical assistance if reasonably required, including calling 000. You agree you are responsible for associated costs charged by third parties (e.g., ambulance/hospital), to the extent permitted by law.

Incident response: RISE coaches follow internal safety and incident procedures, including attendance checks, incident escalation, and contacting Parent/Guardian as soon as practicable.
11) Behaviour Code (Athletes and Parents/Guardians)
RISE is committed to a safe, respectful environment for Athletes, families, and staff.

Expected behaviour:
-
follow coach instructions and safety rules
-
show sportsmanship and respect
-
no bullying, intimidation, harassment, or discrimination
-
no disruptive or aggressive behaviour toward staff, Athletes, or families
-
-
3-strike policy: For non-severe behavioural issues, RISE may issue warnings. Continued breaches may result in removal from the Session and/or cancellation of enrolment.

Immediate removal: RISE may immediately remove an Athlete and/or require a Parent/Guardian to leave for serious misconduct or unsafe behaviour.
-
Fees after removal: If removal occurs due to behaviour, fees are not refundable except where required under ACL.
12) Zero-tolerance conduct
Zero tolerance includes (but is not limited to):
-
violence or threats
-
bullying or harassment
-
discrimination (including on the basis of race, sex, disability, religion, etc.)
-
unsafe conduct that endangers others
-
abusive language or aggressive behaviour toward staff, Athletes, or families
RISE may refuse service or cancel enrolment where necessary to protect safety and wellbeing.
13) Photography/video and marketing consent
-
Automatic consent: By enrolling and attending a RISE Session or Camp, you acknowledge and agree that photos and/or videos may be taken during training and may be used by RISE for promotional and marketing purposes (including website, social media, newsletters, and advertising).

Opt-out process: If you do not want your Athlete to appear in marketing materials, you must notify us in writing (email) before the Session/Camp. We will make reasonable efforts to avoid intentionally filming/photographing your Athlete for marketing purposes.

Incidental capture: We cannot guarantee an Athlete will never appear incidentally in background group footage (e.g., wide shots), but we will not intentionally feature them once an opt-out is recorded.

Withdrawal: You can withdraw consent at any time by emailing us. Withdrawal applies going forward and may not apply to content already published or printed.
14) Drop-off, pick-up, and supervision boundaries (no sign-in/out)

No sign-in/out: Parents/Guardians do not sign Athletes in/out. Coaches will run a roll call at the start of each Session.

Supervision window: RISE supervision applies during scheduled Session times while the Athlete is participating in the Session.
-
Arrival and collection: Parent/Guardian is responsible for the Athlete before the Session starts and after it ends.

Early drop-off / late pick-up: Please avoid early drop-off or late pick-up. If this becomes a repeated issue, RISE may require a Parent/Guardian to remain on-site for future Sessions and/or cancel enrolment for safety reasons.

Leaving the Venue: Athletes may not leave the Venue during a Session unless collected by a Parent/Guardian or unless prior written permission has been provided by the Parent/Guardian.
15) Equipment, uniform, and personal items

Athletes must wear suitable sports clothing and enclosed athletic shoes.

Athletes should bring a water bottle and required medical items.
-
RISE equipment must be used safely and only as directed by coaches.
-
Parent/Guardian is responsible for personal property brought to Sessions; RISE is not responsible for loss or theft to the extent permitted by law.
16) Child safety expectations
-
RISE aims to maintain safe child-focused practices, including appropriate coach conduct and supervision standards.
-
Parent/Guardian must disclose relevant information affecting safety and comply with reasonable safety directions from staff.
-
RISE may refuse participation where it reasonably believes safety cannot be maintained.
17) Privacy and communications (email/SMS/WhatsApp)

Personal information: We collect and use personal information to administer enrolments and deliver Services.
-
Operational communications: By enrolling, you consent to receiving operational messages via email/SMS/WhatsApp (or similar) related to scheduling, Venue updates, and program information.

Marketing communications: Where required, you can opt out of marketing communications using the unsubscribe link or by contacting us.
18) Liability, third-party venues, and limits (to the extent permitted by law)

Inherent risks: You acknowledge the inherent risks of sport (Section 9).

Your responsibility: You are responsible for providing accurate medical/behavioural information and ensuring the Athlete follows safety instructions.

Venues: Many Sessions occur at third-party Venues (schools/hired courts). Venue owners control the premises and may have their own rules and risks. You and the Athlete must comply with Venue rules and directions.

Limits: To the extent permitted by law, RISE is not liable for indirect or consequential loss. Nothing in these Terms limits liability that cannot legally be limited.
19) Force majeure (events outside our control)
RISE is not responsible for failure or delay in delivering Services due to events outside our reasonable control (e.g., natural disasters, Venue closures, public health orders). Where practical, RISE will provide credits or replacements where reasonable and consistent with ACL.
20) Complaints and dispute resolution

If a dispute is not resolved promptly, both parties agree to attempt to resolve it in good faith (including a phone call) before escalating.
21) Changes to these Terms
RISE may update these Terms from time to time by posting the updated version on our website. The updated Terms apply from the date posted (or another date stated by RISE).
22) Governing law
These Terms are governed by the laws of New South Wales, Australia. Any disputes will be dealt with in NSW courts/tribunals unless otherwise required by law.
